These Terms of Service ("Terms") govern your use of the services provided by Mountain Mechanical ("Company," "we," "our," or "us") located at 163 Broadway, Saranac Lake, NY 12983.
By requesting service, accessing our website, or engaging Mountain Mechanical for work, you agree to be bound by these Terms.
1. Services
Mountain Mechanical provides mechanical contracting services, which may include HVAC, plumbing, heating, cooling, repair, installation, and maintenance services ("Services").
All Services are subject to availability, site conditions, and written estimates or service agreements provided to the customer.
2. Estimates and Pricing
Written estimates are valid for 30 days unless otherwise stated.
Final pricing may vary if unforeseen conditions, code requirements, or customer-requested changes arise.
Any additional work outside the original scope will require customer approval.
3. Payments
Payment terms will be outlined in your estimate or invoice.
Payment is due upon completion of services unless otherwise agreed in writing.
Late payments may be subject to interest charges permitted under New York law.
Customer agrees to pay all reasonable collection costs, including attorney’s fees, if necessary.
4. Cancellations and Rescheduling
Customers must provide at least 24 hours’ notice to cancel or reschedule an appointment. We reserve the right to charge a service fee for missed appointments or late cancellations.
5. Access to Property
Customer agrees to provide safe and reasonable access to the property where Services are to be performed. Mountain Mechanical is not responsible for delays or additional costs caused by unsafe or inaccessible work areas.
6. Warranties
Manufacturer warranties apply to equipment and materials as provided by the manufacturer.
Labor warranties, if offered, will be stated in writing.
This warranty does not cover damage caused by misuse, neglect, unauthorized modifications, or normal wear and tear.
Except as expressly stated, services are provided "as is" to the fullest extent permitted by law.
7. Limitation of Liability
To the maximum extent permitted by law:
Mountain Mechanical shall not be liable for indirect, incidental, special, or consequential damages.
Our total liability for any claim arising out of services provided shall not exceed the amount paid for the specific service giving rise to the claim.
8. Indemnification
Customer agrees to indemnify and hold harmless Mountain Mechanical and its employees from any claims, damages, or expenses arising out of misuse of installed equipment or unsafe site conditions not caused by the Company.
9. Compliance with Laws
Mountain Mechanical performs work in accordance with applicable New York State and local building codes and regulations. Customers are responsible for obtaining any required homeowner association approvals unless otherwise agreed in writing.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York. Any disputes shall be resolved in the courts located in New York.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Updated Terms will be posted on our website with a revised Effective Date.
